1. Agreement to Terms & Operating Entity

Welcome to ots.gg (“Platform”, “Service”). These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User”, “you”) and Oleh Riazanov, trading under the brand name ILHI (“we”, “us”, or “our”), governing your access to and use of ots.gg.

By accessing the Platform, creating an account, or purchasing a subscription, you confirm that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must immediately discontinue your use of the Platform.

2. Eligibility & User Accounts

A. Age Requirement

You must be at least 13 years of age (or the minimum legal age required in your jurisdiction) to use the Service. If you are between 13 and the age of legal majority in your jurisdiction, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

B. Account Registration & Security

• To access visual novels, mini-games, and save features on ots.gg, you must register for an account using a valid email address.
• You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
• You agree to notify us immediately at support@ots.gg if you suspect any unauthorized access to or use of your account.
• Accounts are personal to you and may not be shared, sold, transferred, or assigned to any other individual.

3. Subscriptions, Payments & Billing

A. Subscription Model

Access to the catalog of visual novels and mini-games on ots.gg is provided on a recurring subscription basis. Subscription tiers, features, and pricing are displayed on the Platform prior to purchase.

B. Third-Party Payment Processor (Merchant of Record)

All payments, billing, currency conversions, local taxes, and checkout processing on ots.gg are managed directly by Xsolla (xsolla.com), acting as our authorized Merchant of Record.

• When you purchase a subscription, you enter into a transaction governed by Xsolla’s Terms of Consumer Agreement and Privacy Policy.
• We do not store, process, or handle credit card details, banking information, or payment credentials on our servers.

C. Renewal & Cancellation

• Subscriptions automatically renew at the end of each billing cycle (e.g., monthly or annually) unless canceled prior to the renewal date.
• You may cancel your subscription at any time through your account settings page on ots.gg or directly via the Xsolla managing portal.
• Upon cancellation, your subscription will remain active through the end of your current paid billing period.

D. Refunds

All payments processed through Xsolla are non-refundable, except where required by applicable local consumer protection laws or as expressly permitted under Xsolla’s refund policies. Any refund requests must be directed to Xsolla Customer Support.4. Intellectual Property & Ownership

A. Ownership of Platform & Content

All visual novels, mini-games, artwork, narrative text, audio, software, graphics, user interface designs, code, and brand identifiers (including the names ILHI and ots.gg) made available on the Platform are owned by Oleh Riazanov or licensed to us. Content is secured via original creation, Work-Made-For-Hire (WMFH) agreements, or computer-generated technology.

B. No Ownership Transfer

Your subscription or use of ots.gg grants you only a limited right to access and play the content. You do not acquire any title, ownership, or intellectual property rights in or to any game, asset, or material available through the Service.

5. License to Users & Prohibited Conduct

A. Limited License

Subject to your ongoing compliance with these Terms and active subscription status, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and stream the visual novels and mini-games on ots.gg solely for your personal, non-commercial entertainment via supported web browsers.

B. Prohibited Conduct

You expressly agree that you will not:

• Rip or Extract Content: Copy, record, download, scrape, redistribute, re-upload, re-publish, sell, or publicly display any artwork, text, audio, or game assets from ots.gg.
• Reverse Engineer: Decompile, disassemble, reverse engineer, or attempt to derive the source code or underlying architecture of our proprietary gaming technologies or website integrations.
• Cheating & Automation: Use bots, spiders, automated scripts, or unauthorized third-party tools to bypass paywalls, manipulate gameplay choices, or harvest user data.
• Account Misuse: Share subscription access, resell user accounts, or attempt to breach any authentication, security, or subscription enforcement features.

6. Save States, Data Tracking & Service Modifications

A. In-Novel Save System

ots.gg incorporates an in-novel save system utilizing browser local storage and Firebase database synchronization to preserve your story progress and choices across sessions. While we strive to maintain reliable save state retention, we do not guarantee that save progress will never be lost or corrupted due to browser clearing, system updates, or technical errors.

B. Gameplay Analytics

By using the Platform, you acknowledge that custom tracking algorithms log your choices, session duration, and retention within visual novels and mini-games to evaluate story paths and improve platform quality, as described in our [Privacy Policy].

C. Service Availability & Updates

We reserve the right to add, modify, update, temporarily suspend, or permanently remove games, features, or content from ots.gg at any time, without prior notice or liability.

7. Disclaimer of Warranties

The Platform, games, visual novels, save features, and all associated content on ots.gg are provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, whether express, implied, or statutory.

To the fullest extent permissible under applicable law, OIeh Riazanov (trading as ILHI) disclaims all warranties, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
• Any guarantee that the Platform will be uninterrupted, timely, secure, error-free, or free of malicious code or server disruptions.
• Any guarantee regarding the permanent availability, accuracy, or integrity of user save states, gameplay data, or stored progress.

8. Limitation of Liability & Indemnification

A. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Oleh Riazanov, ILHI, or any developers, contractors, or affiliates be liable for any indirect, incidental, consequential, special, or punitive damages—including loss of data, loss of save progress, lost profits, or service interruption—arising out of or in connection with your access to or use of ots.gg.

Our total aggregate liability for any claims arising from or relating to these Terms or your use of the Platform shall not exceed the total amount paid by you for your active subscription on ots.gg during the twelve (3) months preceding the event giving rise to the claim, or $50.00 CAD, whichever is greater.

B. Indemnification

You agree to defend, indemnify, and hold harmless Oleh Riazanov (trading as ILHI) from and against any claims, liabilities, damages, judgments, losses, costs, or expenses (including reasonable legal fees) arising out of your violation of these Terms, your misuse of the Platform, or your infringement of any third-party intellectual property or privacy rights.

9. Governing Law, Dispute Resolution & Contact

A. Governing Law & Jurisdiction

These Terms and any disputes arising out of or related to ots.gg shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

B. Dispute Resolution

In the event of any controversy or claim arising out of these Terms, you agree to first contact us informally at support@ots.gg to attempt to resolve the issue in good faith prior to initiating any formal legal proceeding.

C. Modifications to Terms

We reserve the right to revise or update these Terms at any time. When changes are made, we will update the “Last Updated” date at the top of this document. Continued use of ots.gg following the posting of updated Terms constitutes your acceptance of the changes.
